1. Subject Matter

1.1 These terms and conditions govern participation in the „TICKET TO PARADISE“ competition organised by RAUCH Fruchtsäfte GmbH & Co OG, Langgasse 1, 6830 Rankweil, Austria (subsequently referred to as the „Organiser“).

1.2 The Organiser is also the data controller under data protection law. 

1.3 The Organiser can be contacted via office.at@rauch.cc.

1.4 By participating in the „TICKET TO PARADISE“ competition, the participant accepts the present conditions of participation. Participation in the competition is only permitted on the basis of these conditions of participation. 

2. Participation

2.1 The opportunity to participate in the „TICKET TO PARADISE“ competition begins on 01.01.2024 at 00:00 and ends with the closing date for entries on 31.03.2024 at 23:59. 

2.2 Only natural persons resident in Germany, Austria and Switzerland who have reached the age of 16 at the time of participation are eligible to participate. Participation is only permitted in their own name.

2.3 Persons who work for the Organiser or its affiliated companies or for companies entrusted with the conception or execution of the competition are excluded from participation. This also applies to close relatives (= spouse, partner and relatives in a direct line) of this group of persons.

2.4 To take part in the competition, you must first enter the 7-digit prize code on the label or neck of the Carpe Diem promo bottle and your e-mail address at gewinnspiel.carpediem.com.

All participants will be entered into a draw. At the end, the winners of the scatter prizes and the main prizes will be drawn at random. The winners will be informed by e-mail and must send their address within 3 working days. By doing so, they confirm their acceptance of the prize.

After entering the code, each participant will receive a free online veggie booklet (recipes by Paul Ivić) and a Junglück discount code (-15%).

2.5 Participation is only possible within the participation period. Participation in the competition is voluntary and free of charge. Participation is only possible on the specified homepage.

2.6 Multiple entries are permitted. However, an e-mail address can only be entered into the competition once per day.

2.7 The winners will be drawn at random.

3. Duties of Behaviour, Exemption and Responsibility

Participants who violate these conditions of participation may be excluded from participation by the Organiser at any time. The Organiser has this right in particular against persons who take part in the competition even though they have not yet reached the age of 16.

4. Prizes

A total of 580 scatter prizes and 10 main prizes will be raffled off among all participants.

Scatter prizes:

– 100x Carpe Diem tasting packages (consisting of 2x Carpe Diem Kombucha Classic 0.5l PET bottle and a Carpe Diem jute bag)

– 150x Carpe Diem Magazine short subscription 

– 10x Carpe Diem Magazine Challenge +

– 100x Junglück Niacinamide Serum (1x 50ml)

– 150x Minderleinsmühle tasting packages (1x Minoettly nut butter crunchy coconut 350g and Biofarile organic oat and raspberry cream 100g)

– 70x Carpe Diem hand luggage suitcases (manufactured by travelite GmbH + Co. KG, branded with Carpe Diem logo, dimensions: 40 x 55 x 20cm, volume: 38l)

Main prizes:

10x a weekend trip to the „DAS SIEBEN“ hotel in Tyrol, 6323 Bad Häring, for 2 people. A weekend trip is defined as 2 nights/3 days. The winners will stay in the Junior Suite and half board is included. The value of a main prize is approximately 788 EUR. Additional persons must pay the regular price. The winners will be responsible for their own travel expenses. The voucher is valid for two years from the date of issue.

5. Processing

5.1 The winners of the main prizes and scatter prizes will be determined after the closing date for entries as part of a random draw among all participants who have taken part in the competition by the specified closing date and have fulfilled the conditions for participation. The latest date of the draw is 10.04.2024.

5.2 Settlement of the prize in cash, in other material assets or the exchange or transfer of the benefits to other persons is not possible, unless otherwise stipulated in these conditions of participation. A winner may waive the prize.

5.3 The winners will be announced without guarantee. The prize will only be sent to Germany, Austria and Switzerland. All winners (main prizes and scatter prizes) will be notified by e-mail to the e-mail address provided. If the winner does not provide their contact details and confirm acceptance of the prize within 3 working days, the prize will be forfeited, and a new draw will be held. The winners are responsible for the accuracy of the contact details provided. If winners cannot be contacted due to incomplete or incorrect contact details (e.g. by email, post), this will be at their expense. In the event of non-acceptance, undeliverability, non-collection, deposit or return to the Organiser, etc., the prize will be raffled off again. A new delivery attempt will not be made. 

5.4 Legal recourse is excluded.

5.5 The Organiser expressly reserves the right to terminate or limit the competition at any time without prior notice and without giving reasons. The participant cannot derive any rights from this.

6. Disclaimer of Warranty

6.1 There is no right to participate in the competition, nor does the Organiser guarantee that the technical facilities for participating in the competition will be available continuously and/or without disruption.

6.2 The Organiser accepts no liability for lost chances of winning.

7. Liability

7.1 The following exclusions and limitations of liability apply to the Organiser’s liability. The other statutory provisions remain unaffected by this.

7.2 Liability exists only for direct damage caused intentionally or through gross negligence. Any further liability is excluded, unless personal injury is involved. Liability under the Product Liability Act remains unaffected by this.

7.3 As far as the Organiser’s liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents of the Organiser.

7.4 In the case of travel prizes, the Organiser is also not liable for the consequences of a justified change to the travel offer or the justified cancellation of the trip by the Tour Operator. The possibility of paying out the value of the trip is excluded.

7.5 The Organiser is not liable for the accuracy of any information, in particular if it has been altered or falsified due to technical errors, typographical or programming errors, transmission losses, interference by third parties or force majeure.

8. Applicable Law, Severability Clause, Other Terms

8.1 This competition is subject exclusively to the law of the Republic of Austria, excluding the conflict of law rules.

8.2 Should any provision of these Terms and Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these Terms and Conditions of Participation. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic intent and purpose of the invalid provision. The same applies in the event of a loophole in these Terms and Conditions of Participation.

8.3 All personal and functional designations used in these Terms and Conditions of Participation, which have been used in the masculine form for reasons of better readability, also apply in the feminine form.

9. Reservation of Right of Amendment

The Organiser may amend or supplement these terms and conditions at any time without giving reasons if this is necessary.
